Introduction

What is a Sponsor Licence?

A Sponsor Licence is for a registered businesses in the UK to seek a licence from the Home Office to be able to employ people from overseas. Businesses need to seek this licence so that the Home Office can monitor the buisness and its practices, so they know that the overseas employees have entered the UK legally, are following the correct rules whilst in the UK, and are being treated fairly for the work that they have been employed to do. There are many rules, requirements and checks on a buisness to be a sponsor of overseas skilled workers and the Home Office requires businesses to take that responsibility seriously.

This is because Sponsorship is based on 2 main principles. The first is that that sponsoring is privilege and not a right, meaning that those who benefit from employing migrant workers must ensure that the immigration system is not abused, that they are complying with the wider UK law and, not behaving in a manner that is not conducive to the public good. The second principle is that the overseas worker is trustworthy, eligible for the job that they are applying for, and the people employing them are licensed and genuinely want to sponsor them.

  • Your company must be a UK registered company
  • That you will be able to comply with all your duties as a sponsor
  • Have a genuine job vacancy that cannot be fulfilled adequately with the UK work force, unless that vacancy is on the shortage of occupation list

There are many reasons why a Sponsor Licence may be rejected, however, we advise and examine all our clients’ businesses to make sure that they would be good candidates before making an application. This is because the Home Office doesn’t just inspect immigration related parts of your business but all aspects and so it is prudent to make sure that your company is already operating in a way that is currently expected of it.

How long is your Sponsor Licence valid for?

Your Sponsor Licence will be valid for 4 years, and steps will need to be taken in order to renew your licence before it expires.

What are the benefits of being a sponsor?

There are many immediate benefits like being able to fill vacancies that you haven’t been able to thus far. However, secondary to this, are benefits like increased brand awareness and being added to an approved list of Sponsors so people will know that your business is reputable.

What is a Certificate of Sponsorship (CoS) and why is it relevant to my Sponsor Licence?

A Certificate of Sponsorship (CoS) is an electrotonic certificate which is a record assigned to each foreign worker that you wish to employ. It is relevant to a Sponsor Licence because when making your application you will need to state to the Home Office how many CoS should be assigned to your buisness. The number that is assigned to you will be the number of foreign workers that you will be able to sponsor at any given time.
