Indefinite Leave to Remain (ILR) under the 10 Years Lawful Residence route is a settlement category for individuals, who have lived in the UK continuously and lawfully for 10 years. It allows long‑term residents to apply for permanent status, regardless of the type of visas they have held during that period.

This route is designed for people who have built a stable life in the UK and have maintained lawful immigration status throughout their stay.

Eligibility

Who is Eligible for Indefinite Leave to Remain (10 Year Lawful Residence)?

*Please note that this list is non-exhaustive and further information may be required and advised upon seeing our instruction*

  • You must be 18 or over at the time of application.
  • 10 years of continuous residence, meaning that you have not been outside the UK for any period that is longer than 180 days in any 12 month period, and a total of 540 days in the whole of the 10 years preceding the application.
  • Have been in the UK lawfully, meaning that you have always had a valid visa and have not overstayed for any period longer than 14 days, during your 10 years in the UK.
  • You will need to have completed the Life in the UK test as well as other English Language requirements, unless exempt, which we will of course be able to guide you on whether an exemption applies to your specific case
  • You cannot count any time spent in the UK on a visitors visa

How long can you live outside the UK without losing your Indefinite Leave to Remain (ILR)?

No more than 2 years. If you have been outside the UK for more than 2 continuous years you will lose your Indefinite Leave to Remain.

If there is a good reason for you being gone longer than 2 years you would want to explore the option of applying to come back to the UK as a Returning Resident.

Do I need to renew my Indefinite Leave to Remain (ILR)?

Your Indefinite Leave to Remain does not expire. However, if you are outside the UK for longer than 2 years continuously or commit a serious crime, your ILR can be revoked.

If your passport which has your ILR stamp inside it has expired or your BRP card has expired, you will be required to apply for an eVisa to prove your status in the UK.

How long does it take for the Home Office to process my application for ILR (10 Years long residence)?

Standard processing time is 6 months, but it may take longer depending on the complexity of the case and Home Office availability.
