Introduction

What is a Child of a Settled Parent Application?

There are 2 applications that may be available to any child of a settled parent.

The first application is for Indefinite Leave to Enter under Part 8 of the Immigration Rules. This is an application that is made from outside the UK and allows a child to join their settled parent in the UK.

Where your parent becomes settled whilst you are in the UK, you will also become eligible to apply for settlement. This is the second type of application that can be made under this section. It is and application for Indefinite Leave to Remain as the child of a settled parent and is made from within the UK.

Who is Eligible for a Child of a Settled Parent Application?

  • In both cases, the child in question must be under 18 at the time of their application.
  • In both cases, the parents of the child in question must be a British National or Settled in the UK in one form or another

There are eligibility differences depending on the type of application that you will use as the child of a settled parent. We will need to assess this on a case-by-case basis to make sure that the right approach is taken. Once assessments have been made, we will be able to provide you with a non-exhaustive list of the eligibility requirements for that route.

Can I apply for my Child’s British Passport if I have ILR?

You can apply for your child’s British Passport once they have received their ILR and have registered as a British Citizen. Unless the child was born after the settled parents received their ILR. In this instance that child will be able to apply for a British Passport immediately as they have been born British.

Can I get Indefinite Leave to Remain though my child?

No, but you can apply for limited leave to remain if you have sole responsibility for your settled child. Please contact us if this is the case and we will be able to give you further information and guidance on this.

How long will it take for my child to obtain their Indefinite Leave to Enter?

The Home Office can take up to 3 months to consider the application.

How long will it take for my child to obtain Indefinite Leave to Remain?

The Home Office can take up to 6 months to consider the application.
