What is a Indefinite Leave to Remain (10 Years Lawful Residence)?

If you have spent a period of 10 years living in the UK continuously and lawfully you may be able to apply for Indefinite Leave to Remain (ILR). ILR provides the ability to stay in the UK indefinitely. Once you’ve been granted ILR, if you leave the UK for more than 2 years you will lose your ILR.

Eligibility

Who is Eligible for Indefinite Leave to Remain (10 Year Lawful Residence)?

*Please note that this list is non-exhaustive and further information may be required and advised upon seeing our instruction*

  • You must be 18 or over at the time of application.
  • 10 years of continuous residence, meaning that you have not been outside the UK for any period that is longer than 180 days at a time, and a total of 540 days in the whole of the 10 years preceding the application.
  • Have been in the UK lawfully, meaning that you have always had a valid visa and have not overstayed for any period longer than 14 days, during your 10 years in the UK.
  • You will need to have completed the Life in the UK test as well as other English Language requirements, unless exempt, which we will of course be able to guide you on whether an exemption applies to your specific case

How long can you live outside the UK without losing your Indefinite Leave to Remain (ILR)?

No more than 2 years. Any time after this period will mean that you lose your Indefinite Leave to Remain. If there is a good reason for you being gone longer than 2 years you would want to explore the option of applying to come back to the UK as a Returning Resident.

Do I need to renew my Indefinite Leave to Remain (ILR)?

Your Indefinite Leave to Remain lives in perpetuity unless you are outside the UK for longer than 2 years or commit any serious crimes causing your ILR to be revoked. Having said this, even though your ILR is continuous, your BRP (Biometric Residence Permit) card has an expiry dated and will continue to need to be renewed at the appropriate indicated times.

How long does it take for the Home Office to process my application for ILR (10 Years long residence)?

Standard processing time is 6 months, but it may take longer depending on the complexity of the case.
