Introduction

What is a Spouse, Civil Partner or Unmarried Partner?

This section is split out into Permission to Enter, Extension of Stay and Indefinite Leave to Remain.

Permission to Enter is where you are outside the UK and are applying to enter the UK to live with your sponsor who is also either your Spouse, Civil Partner or Unmarried partner.

An Extension of Stay is exactly as it reads, where you are applying to extend the current stay that has already been granted to you as a Spouse, Civil Partner or Unmarried partner. This application can only be submitted from within the UK.

Indefinite Leave to Remain is where, after you have fulfilled a clean qualifying period of time required by the home office, you can apply for permission from the home office to remain in the UK indefinitely.

This route is a route that leads to settlement as once you have obtained your Indefinite Leave to Remain you can then go on to Naturalise and become a British Citizen.

If you are the Spouse, Civil Partner or Unmarried partner of a British Citizen and whish to reside in the UK with your significant other this is a route that could be available to you with the proper evidencing of your relationship.

Eligibility

Who is Eligible for the Spouse, Civil Partner or Unmarried Partner Route?

*Please note that this list is non-exhaustive and further information may be required and advised upon seeing our instruction*

  • At the time of the application you and your partner will both have to be 18 and over
  • Your partner/ sponsor must be a:
    • British Citizen or
    • Have Settled Status/ Indefinite Leave to Remain in the UK or
    • Be of an EU Citizenship with Pre-Settled Status and was living in the UK before 1st Jan 2021 or
    • Have Refugee Status or Humanitarian Protection
  • You will also need to meet English Language and Financial Requirements

What is an Unmarried Partner?

Someone who is in a relationship with a person who is present and settled in the UK, but is not married to said person, can enter the UK as an Unmarried Partner. They will need to show 2 years of evidence of their relationship prior to their application.

What is the difference between a Civil Partner and a Spouse?

There is no difference in terms of the application, only in how a couple chooses to define their relationship.

What is faster a Spouse or Fiancé Visa?

A Spouse Visa is faster as with a Fiancé Visa you will be granted 6 months to enter the UK to get married and then apply again after the wedding has taken place for a Spouse Visa.
